Frequently Asked Questions
General Questions
Do I need a lawyer for my family law matter?
Not always—but getting early legal advice can help you understand your rights and avoid complications down the track. We can guide you on whether your matter needs formal representation or if one-off advice will suffice.
What should I bring to my first appointment?
Bring any relevant documents (e.g. Court orders, documents you’ve been served, proof of income if you’re applying for Legal Aid, and photo ID), plus a brief summary of your situation. Don’t worry if you don’t have everything—we’ll help you work through it.
Can I just get some advice without going to Court?
Yes. We regularly provide independent advice outside of the Court process. We’ll help you understand your options and what steps (if any) to take next.
Where is your office?
We’re based in Hamilton, New Zealand. 109 Anglesea Street is the multi-level grey building directly across the road from the Courthouse. We are up on the first floor, follow the signs to our offices.
Will you be my lawyer if my proceedings aren’t in the Hamilton Court?
Yes. We regularly appear in nearby rural Courts such as Huntly, Morrinsville, Te Awamutu, and Te Kuiti. We also act for clients based in Waikato with proceedings elsewhere in New Zealand, including Auckland and Tauranga.
Costs & Legal Aid
Do you offer Legal Aid?
Yes—we’re approved Legal Aid providers. If you’re eligible, we can help with the application process. Just bring proof of income to your appointment.
How do I know if I qualify for Legal Aid?
Eligibility depends on your income and assets. We can give you an idea during our first conversation, or you can check the Ministry of Justice website.
What if I’m not eligible for Legal Aid?
We offer private representation and will give you a clear idea of likely costs upfront.
Parenting & Guardianship
How do I get a Parenting Order?
There are a few different ways to get a Parenting Order. After meeting with you we can advise you on the best option for you. If you need to go through the Family Court, we can help you make an application and represent you throughout the process. When in Court, sometimes Parenting Orders are made by agreement once proceedings are underway; other times, a Judge will decide at a hearing.
What happens if I need to relocate with my child?
Relocation disputes can be complex. Every situation is different, so we would need to meet with you in order to provide tailored advice right for your circumstances. We’ll guide you through the legal requirements and help you understand what the Court considers important.
Family Violence
How do I apply for a Protection Order?
We can help prepare your application and support you through the process, including advising you on urgent (without notice) applications if needed. The first step is to book a confidential meeting with one of our team so you can understand your rights and the options available to you. If you decide not to go any further, that’s completely okay.
Can I defend a Protection Order made against me?
Yes. If you’ve been served with an application, we can provide advice and representation. It’s important to understand what a Protection Order is and the rules you need to follow to keep yourself safe. We’ll explain everything clearly and help you explore your options for responding in Court.
Oranga Tamariki Involvement
Oranga Tamariki contacted me—what should I do?
Get legal advice as soon as possible. These matters can move quickly, and early support can make a big difference. Even if you’re not involved in Court proceedings, you may still qualify for Legal Aid. We can help you engage with Oranga Tamariki and understand your rights as a parent or caregiver.
What is a Family Group Conference?
It’s a meeting where Oranga Tamariki, whānau, and other key people come together to discuss concerns and develop a plan. We can help you prepare and usually attend with you.
Other Legal Areas
Do you handle Relationship Property or Child Support disputes?
These aren’t areas we currently take on. Our focus is on other aspects of Family Law, but we’re happy to point you in the right direction if you need help finding someone who does.
